    By engaging our tax protest services, you grant EasyTaxProtest authority to act as your property tax agent or authorized representative before the relevant county appraisal district and appraisal review board. You agree to execute any documents reasonably necessary to effectuate this authorization, including but not limited to agent authorization forms required by the applicable taxing authorities.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

EASYTAXPROTEST DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. EASYTAXPROTEST DOES NOT GUARANTEE ANY SPECIFIC OUTCOME OR RESULT FROM THE USE OF ITS TAX PROTEST SERVICES, INCLUDING BUT NOT LIMITED TO ANY REDUCTION IN PROPERTY TAX ASSESSMENTS.

    11. Limitation of Liability

    IN NO EVENT SHALL EASYTAXPROTEST BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE WEBSITE OR SERVICES. EASYTAXPROTEST'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE AND SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO EASYTAXPROTEST IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, limitations of liability, and the arbitration agreement.

    15. Binding Arbitration

    PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

    You and EasyTaxProtest agree that any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or to the use of the website or services (collectively, "Disputes"), shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules and Mediation Procedures then in effect (the "AAA Rules"), except as modified by this section.

    Agreement to Arbitrate. You and EasyTaxProtest mutually agree that any Dispute shall be resolved solely through final and binding arbitration, and not by a court or jury. You acknowledge and agree that you are waiving your right to a trial by jury and to participate in a class action.

    Class Action Waiver. ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU AND EASYTAXPROTEST AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. The arbitrator shall not have the authority to consolidate or join the claims of other persons or parties who may be similarly situated.

    Location and Procedure. The arbitration shall take place in Travis County, Texas, unless otherwise agreed by the parties. The arbitration shall be conducted by a single arbitrator selected in accordance with the AAA Rules. The arbitrator shall apply the laws of the State of Texas, consistent with the Federal Arbitration Act, 9 U.S.C. Β§ 1 et seq. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

    Costs and Fees. Payment of all filing, administration, and arbitrator fees shall be governed by the AAA Rules. If you demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, EasyTaxProtest will pay as much of the filing and hearing fees as the arbitrator deems necessary to prevent the cost of accessing the arbitration forum from being prohibitive.

    Exceptions. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. Claims within the jurisdiction of a small claims court may also be brought in such court.

    Opt-Out. You may opt out of this arbitration agreement by sending written notice of your decision to opt out to: SB Tax Solutions LLC, 13809 Research Blvd., Suite 500, Austin, TX 78750, within thirty (30) days of first accepting these Terms. Your notice must include your name, address, email address, and a clear statement that you wish to opt out of this arbitration agreement.

    16. Waiver of Jury Trial

    To the extent permitted by applicable law, you and EasyTaxProtest hereby waive the right to a trial by jury in respect to any claim, counterclaim, or action arising from or related to these Terms or your use of the website and services.

    17. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to any principles of conflicts of law. Subject to the arbitration provision above, any legal action or proceeding not subject to arbitration shall be submitted to the exclusive jurisdiction of the state or federal courts located in Travis County, Texas.

    18. Severability

    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

    19. Entire Agreement

    These Terms, together with the Privacy Policy and Copyright Notice (collectively, the "Website Policies"), constitute the entire agreement between you and EasyTaxProtest regarding the use of the website and our services, superseding any prior agreements between you and EasyTaxProtest relating to your use of the website.
